Robbinsville – Lake Santeetlah council members arrived Monday to Graham County court for an assault case – ready for a trial – but left instead with a continuance to Jan. 29, 2024.
Town of Lake Santeetlah councilwoman Diana Bonham Simon was charged with assault on a government official against Town of Lake Santeetlah Mayor Connie Gross following an incident at the June 8 council meeting.
The reason for the continuance is so Gross can list the witnesses of the assault to testify in court.
On June 8, the council was discussing the appointment of substitute members to the town’s planning board. Mayor Gross made a motion to appoint Jack Gross – her husband – as an alternate. Simon also made a motion for Ralph Strunk. Councilmember Tina Emerson clarified that a motion was already made for Jack Gross.
The council went into a vote to accept Jack Gross as an alternate. Gross, Emerson and Ralph Mitchell voted yes. Simon and councilmember, Jim Hager voted no.
Mayor Gross made a motion for another alternate.
Simon cried out, “No” three times, forcefully grabbed Mayor Gross’ arm and yelled, “No, I had a motion first.”
Simon pushed on Gross’ arm towards Emerson before releasing her grasp.
The council – along with some residents – were present for the meeting and witnessed the event. The incident was caught on video and is on The Graham Star’s YouTube page.
Connie filed a charge against Simon that night to the Graham County Sheriff’s office.
According to the incident report, Sgt. David Moore spoke with Gross. She showed him her right arm, which was red from the assault. The officer also reviewed the livestream video.
Gross wanted to pursue charges.
Moore located Simon at her home and issued her a citation for assault on another person.
