Viar arraigned on statutory sex charges

Robbinsville – A mere seven days passed between Devin McKinnley Viar’s DWI conviction and new charges being filed on the 25-year-old former Graham County sheriff’s deputy.

Viar, who lists an address of 452 Old U.S. 129, had a warrant for his arrest filed on Oct. 14. He has been charged with three felonious counts of statutory sexual offense with a child by an adult.

He appeared in Graham County District Court on Oct. 29, where he was given a $1.5 million bond. He remains in custody, with his next appearance scheduled for Monday, Nov. 16.

The warrant alleges that between Oct. 1, 2019, and May 31, 2020, Viar engaged in sexual acts with a 5-year-old girl. Charges were filed just one week after Viar’s 2019 driving while impaired case was settled.

A former deputy with the Graham County Sheriff’s Office, Viar was pulled over on Old U.S. 129 around 10:55 p.m. July 14, 2019, after authorities noticed he swerved “left of center” several times. Viar “displayed red, glassy eyes, slurred speech” and “performed poorly” on the field sobriety test. He was booked that night and soon after, terminated by the sheriff’s office.

As part of the sentence handed down Oct. 7 on the DWI, Viar was ordered to serve 12 months of unsupervised probation, pay $660 in court costs and serve 24 hours of community service.
